Article 2 – Applicability
These general terms and conditions apply to every offer from Radaya Home and to every distance agreement concluded between Radaya Home and the consumer.
Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, Radaya Home will indicate how the general terms and conditions can be consulted.
Radaya Home reserves the right to change these conditions. The most current version can be found on the website.
Article 3 – The Offer
Radaya Home offers the following products via its webshop:
– Reed diffusers
– Fragrance oils
– Testers
All offers are without obligation. Radaya Home reserves the right to change or withdraw the offer. Obvious mistakes or errors in the offer are not binding on Radaya Home.
Each offer contains a description of the products offered that allows the consumer to make a good assessment. Images on the website are a true representation of the products offered. Visible color differences due to screen display are reserved.
Article 4 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set therein.
Radaya Home confirms receipt of the acceptance of the offer electronically. As long as the receipt has not been confirmed, the consumer can dissolve the agreement.
Radaya Home can ascertain whether the consumer can meet his payment obligations, as well as all facts and factors that are important for a responsible conclusion of the distance agreement. If, on the basis of this investigation, Radaya Home has good reasons not to enter into the agreement, it is entitled to refuse an order or to attach special conditions to its execution.
Article 5 – Right of Withdrawal
The consumer has the right to dissolve the agreement without giving reasons during a reflection period of 14 days after receipt of the product.
To exercise the right of withdrawal, the consumer must notify this in advance via e-mail: info@radaya.nl. After confirmation, the product can be returned.
Conditions for return:
– The product is unopened and unused
– The product is in its original packaging
– The product is not damaged
Products that do not meet the above conditions will not be accepted as returns.
The costs for returning are for the account of the consumer. The return package is sent at the consumer's own risk. Radaya Home is not liable for loss or damage during return transport.

Article 6 – Obligations upon Withdrawal
After dissolution of the agreement, Radaya Home will refund all payments from the consumer, including any delivery costs, within 14 days after receipt of the returned product at the latest.
Radaya Home uses the same payment method for repayment that the consumer used, unless the consumer agrees to a different method. The refund is free of charge for the consumer.
Article 7 – Exclusion of Right of Withdrawal
The right of withdrawal is excluded for:
– Products that have been opened after delivery for hygiene reasons and can no longer be returned
– Products that cannot be returned due to their nature
– Products that are clearly personal in nature
Radaya Home will inform the consumer in good time if the right of withdrawal is excluded for a specific product.
Article 8 – Price
The stated prices include VAT. Any additional costs (such as shipping costs) will be clearly stated before completing the order.
Radaya Home reserves the right to change prices. For ongoing orders, the price that applied at the time of ordering applies.
Obvious errors in the price quotation, such as obvious inaccuracies, are not binding on Radaya Home.
Article 9 – Payment
Payments are securely processed via Mollie. The following payment methods are available:
– iDEAL
– Credit card
– Klarna
– Other available methods via Mollie
The consumer must pay immediately for orders placed via the webshop. In case of non-payment or late payment, Radaya Home has the right to dissolve the agreement.
Article 10 – Delivery and Execution
Radaya Home strives to process and ship orders as quickly as possible. The following delivery times and conditions apply:
– Orders placed on working days before 12:00 PM will be delivered the next working day
– Shipping costs are free
– Radaya Home currently delivers within Europe
Radaya Home is not liable for delays that are beyond its control, such as with the carrier.
If delivery is delayed or an order cannot be carried out or can only be carried out partially, the consumer will be informed of this as soon as possible. In that case, the consumer has the right to dissolve the agreement free of charge.
Article 11 – Conformity and Warranty
Radaya Home guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and usability, and the statutory provisions and government regulations existing on the date of the conclusion of the agreement.
If the delivered product does not comply with the agreement, the consumer must report this in writing to Radaya Home via info@radaya.nl within a reasonable period after discovery.
Article 12 – Complaints
Complaints about the execution of the agreement can be submitted via:

Radaya Home strives to respond to complaints within 14 days of receipt. If a complaint requires a longer processing time, the consumer will receive an acknowledgment of receipt and an indication of the expected processing time within 14 days.
Article 13 – Liability
Radaya Home is not liable for damage resulting from:
– Incorrect use of the products
– Force majeure or circumstances beyond the control of Radaya Home
– Loss or damage of returns during transport
The liability of Radaya Home is in all cases limited to the amount the consumer has paid for the product in question.
Article 14 – Force Majeure
Radaya Home is not obliged to fulfill any obligation towards the consumer if it is prevented from doing so as a result of force majeure. Force majeure is understood to mean: any circumstance independent of the will of Radaya Home, which prevents the fulfillment of its obligations.
Article 15 – Personal Data
Radaya Home processes personal data of the consumer in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our Privacy and Cookie Policy, which can be found on our website.
Article 16 – Applicable Law and Disputes
Agreements between Radaya Home and the consumer are exclusively governed by Dutch law.
Disputes between the consumer and Radaya Home can be submitted to the competent court in the district of Amsterdam.
The consumer also has the right to use online dispute resolution via the ODR platform of the European Union: https://ec.europa.eu/consumers/odr/
